This agreement is entered into between Kristin Baker, on behalf of Kristin Baker Photography & Design, LLC (hereafter referred to as “Photographer,” “Photography Company,” or “Company”), and Erin Morgan (hereafter referred to as “Client”). This agreement supersedes all prior or concurrent agreements between the parties. Any amendments or additions must be made in writing and signed by both parties. If any part of this agreement is found to be unenforceable, the remainder will remain valid. A waiver of any provision does not waive other provisions or future enforcement.

Scope of Work

This contract covers photography services and related products for a scheduled Newborn Session. The Client and Photographer agree to meet at Kristin Baker Photography + Design at 9:30am on 6/3/26 for the session. The Photographer agrees to provide a proofing gallery containing no fewer than 22k professionally composed, unedited edited images within 21 days of the session date. The Client will then have 48 hours to select 20 images from the proofing gallery and must notify the Photographer once selections are made. Final edited images will be delivered within 30 day total from the date of the session. Basic editing and post-processing will be applied to the selected final images at the Photographer’s discretion to ensure quality and artistic consistency. 

Fees

The Client agrees to pay $1,450 (plus tax and credit card surcharge, if applicable) for the Luxe Newborn Collection. A non-refundable 50% reservation fee (plus applicable tax and surcharge) is due at the time of booking to reserve the session date. This fee secures the Photographer’s time. The remaining balance of  $725 (plus tax and surcharge) is due at the conclusion of the session.  If not paid within 3 days post-session, a $25 late fee will be added weekly until the balance is paid. Final images will not be delivered until the balance is paid in full.

COVID-19 Studio Policies

The Client acknowledges the risk of exposure to COVID-19 and assumes full responsibility for participation in the session. The Client waives the right to seek damages or compensation from Kristin Baker Photography and Design, LLC.

Work Product

Proofing galleries will be delivered no later than 21 days following the session. Clients are responsible for selecting their final images within 48 hours of receiving the gallery. If no selections are made in that time, the Photographer reserves the right to select and deliver the final images. Final images will be edited and delivered electronically within 30 calendar days from the date of the original session.

Final galleries will remain active for 30 days from delivery. Galleries not downloaded within that period will incur a $50 archival fee for reactivation within the following 6 months. After 6 months, the Photographer is not obligated to maintain any files or galleries.

All images are licensed for personal use only.

Retouching

The Photographer will not release raw, unedited files under any circumstances. Proofing images are lightly edited; final selections will be fully edited to the Photographer’s artistic standards. Temporary blemishes (e.g., acne, bruises) may be removed. All additional editing requests (e.g., body reshaping, head swaps, object removal) may incur extra charges at the Photographer’s discretion.

Indemnification  

The photographer and the client agree that the photographer is under no obligation to capture any specific moment or pose during the shoot. If the photographer is unable to perform the services in this contract due to illness, emergency, fire, casualty, strike, act of God, epidemic, pandemic, or causes beyond control of the photographer, the photographer and client shall make every attempt to reschedule to photographic event. The client agrees to indemnify the photographer for any loss, damage, or liability. Client agrees to indemnify and hold harmless the photographer for any liability, damage, or loss related to technological failure, including data loss. Client agrees to hold the photographer harmless for any personal injury which may occur as the client poses or works with the photographer. Client understands and agrees that the photographer is not required to maintain copies of the photos from the shoot thirty days (30 days) after the photos have been delivered to the client. If the session requires postponement, the photographer and client will agree upon another weekday for the session to be rescheduled. The photographer is not required to refund the session deposit in the event of a cancellation or postponement; however, the deposit is transferable to another session with the photography company within 60 days of the scheduled session. The photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the client. 

Duty of the Client

The Client agrees to cooperate with the Photographer to achieve the best results and follow posing directions. The Photographer is not responsible for a lack of cooperation, expressions, or behavior—regardless of participant age.

Model Release

The Client grants Kristin Baker Photography & Design the right to use, reproduce, and publish session images for promotional, editorial, advertising, or educational purposes, in print or digital format, and to copyright the same without restriction. The Client waives any claims to profits or usage rights.

Copyrights

All images are the intellectual property of Kristin Baker Photography & Design and are protected under U.S. copyright law. Clients may share purchased digital files online for personal use with proper credit. Images may not be altered, used commercially, or entered into contests without written permission. Printing rights are granted only for personal use.

Printing

The Client will receive a print release for personal use. The Photographer does not guarantee print quality from third-party labs. For best results, all printed products should be ordered directly through Kristin Baker Photography & Design.

Photographer

In the event the Photographer is unable to perform due to extenuating circumstances, a comparable replacement photographer will be arranged at no additional cost. If no substitute is available, all fees, including the deposit, will be refunded in full.

Safety

The Photographer reserves the right to terminate a session immediately if safety is at risk or if inappropriate, hostile, or offensive behavior is present. No refunds will be given in such cases.

Exclusive Photographer

Only the Photographer may capture images during the session. No other cameras or devices may be used to photograph or video any poses, lighting setups, or compositions created by the Photographer. This policy ensures the quality and integrity of the final images.

Assignability and Parties of Interest

Unless otherwise stated, the Client understands that services are rendered by Kristin Baker Photography & Design, and not any individual photographer. The company will ensure services are provided in a professional, workmanlike manner.

Cancellation & Rescheduling

All cancellations or rescheduling requests must be submitted in writing via email at least 24 hours in advance of the scheduled session.

• If notice is given less than 24 hours before the session, the retainer will be forfeited and a new deposit will be required to rebook.
• If the session is rescheduled with more than 24 hours’ notice, the original deposit will be applied to a new session. The rescheduled session must take place within 60 days of the originally scheduled session or due date.

Please note: Session availability is limited and rescheduling is based on the Photographer’s availability.

Tardiness

Clients are expected to arrive on time for their scheduled session.

• If the client is more than 15 minutes late, the session time will be reduced accordingly and will not be extended or rescheduled.
• Refunds or credits will not be issued for late arrivals or sessions shortened as a result.
